1. The Presenter of the duck race fundraiser is The Rotary Club of Estes Park, Colorado.
  2. Prior to commencing the offering of Adoptions, the Presenter shall:
    • Select the date of the event (“Race Day”)
    • Designate the Participating Organizations who are eligible to share in the earnings of the duck race fundraiser.
    • Determine the portion of gross adoption proceeds to be distributed to the Participating Organizations.
    • Provision and operate the means by which Adoptions can take place.
  3. Prior to Race Day, the Presenter shall
    • Designate the racecourse and determine the format of the duck race(s). In the case where a multiple-flight race format is used, the Presenter will establish the Qualifying Threshold, which is the number of Race Entries that first finish in a flight, thereby qualifying to compete in the final race.
    • Gather Prizes to be awarded to the winning Race Entrants following each flight/race.
  4. Individuals are encouraged to adopt one or more ducks by the means provisioned by the Presenter. Each successful Adopter is then associated with one or more Adopted Ducks. Adopters may also designate the Participating Organization who will ultimately earn a share of their Adoption proceeds.
  5. Subsequent to their Adoption, each Adopted Duck will ultimately be assigned to a specific physical duck, which in turn is assigned to a flight/race on race day. The physical duck represents a Race Entry, which may result in a prize award to the Adopter, or their designee (either being a “Race Entrant”) associated with a physical duck. For Quack Packs, the additional sixth “free” duck is not considered an Adopted Duck but shall be an additional Race Entry for the benefit of the designated Race Entrant.
  6. Ducks assigned to a given flight/race will be dropped en masse at the designated starting line on Race Day. The number of physical ducks dropped will be no less than the number of Race Entries assigned to that race. Only physical ducks associated with a Race Entry are eligible to win a Prize.
  7. Once the physical ducks are launched, they are on their own. However, attempts may be made by the Presenter or its designated agents, and by no one else, to keep the ducks moving. The volunteers or person(s) overseeing each flight shall instruct all volunteers or other personnel that they are not to interfere with the progress of the ducks on the race course. If the Presenter or its designated agents determine that the ducks require to be moving forward, then such attempts to move the ducks forward shall not be deemed to be interference in the race. It is possible that some ducks may never complete the Race, due to natural hazards or impediments in the river.
  8. In the case where a single race format is used, the available Prizes are distributed randomly among the Race Entries that first finish.In the case where a multiple-flight race format is used, prizes are allocated among the flights such that the total number of available Prizes relative to the total number of Race Entries is consistent across all flights and the final race.

    Race Entries that finish first, at or below the Qualifying Threshold, will be reserved to compete again in the final race.

    The Prizes allocated to a flight will be awarded to Race Entries first finishing above the Qualifying Threshold. All Race Entries competing in the final race will be awarded Prizes.

  9. Chances of winning are determined by the total number of Available Prizes and the total number of Race Entries.
  10. Race Entrants that are awarded Prizes will be notified by email following the flight/race. Prize notifications will identify the prize(s) won and contain instructions on how to redeem the prize(s). Prize awards may also be published by other means as determined by the Presenter.Race Entrants must have a valid, legible email address on their associated Duck Adoption to be eligible for a prize. Race Entrants should whitelist or otherwise allow email from DuckCentral@EPDuckRace.org. Should a Race Entrants email address change after entering the race but before winner notifications are sent by email, the Race Entrant can change his/her/their email address by emailing their name name and old email address to DuckCentral@EPDuckRace.org from the Race Entrant’s new email address.

    If a Race Entrant believes they were awarded a prize, but did not receive a prize notification, they must contact DuckCentral@EPDuckRace.org no later than June 15 following Race Day in order to claim the prize awarded. If the Race Entrant fails to notify DuckCentral@EPDuckRace.org by midnight on June 15, at the sole and complete discretion of the Presenter, the awarded prize shall be forfeited. All Prizes must be redeemed by the Expiration Date on the prize notification. All taxes, and any costs for shipping and handling the prize after award, are the responsibility of the winning Race Entrant.

  11. A purchase is not necessary to win a prize. One free Race Entry per household may be obtained by contacting The Rotary Club of Estes Park at P.O. Box 1226, Estes Park, CO 80517 for instructions and a Free Race Entry form that must be submitted. The Race Entry form must be received and processed by the Presenter at least one day prior to Race Day to participate as a Race Entrant.
  12. By adopting a duck, the Adopter acknowledges that there are no refunds of any kind after checkout, and credit card charges cannot be disputed. The person submitting the Adoption should consult his/her/their tax advisor regarding any tax deductibility matters.
  13. All physical ducks will be provided by the Presenter and shall remain the property of the Presenter.
  14. Winners consent to the promotional use of their names and likenesses without compensation.
  15. By entering, each Race Entrant acknowledges that the Presenter has no liability whatsoever for any injuries, losses, or damages of any kind resulting from the acceptance, possession, or use of the prize.
  16. Personal information collected during the process of registering as a Race Entry, is subject to the Privacy Policy posted on the Presenter’s website at www.EPDuckRace.org/privacy-policy
